Terms of Service

These Terms govern your use of Both Yards (the Home + Work app), operated by Zachary Flick (d/b/a Flick’s Customs) (“we”, “us”), at bothyards.com, app.bothyards.com, and our Android app (the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. Questions: support@bothyards.com.

1. Accounts

You must give accurate information, be at least 13 years old (or the minimum age in your country), and keep your password safe. You are responsible for activity under your login. One login can hold Home places and Work places; they stay separate.

2. Places, owners and members

The person who creates a Home or Work place is its owner. Owners decide who joins, what members can see, and they pay for the place’s plan. Members and employees use the place under the owner’s plan and do not pay. Owners are responsible for having the right to add the people and information they put into a place.

3. Your content

You keep ownership of what you and your members enter (lists, inventory, jobs, customers, messages and similar content). You give us permission to store, process and display it only to run and improve the Service for you. We don’t sell your content.

4. Acceptable use

Don’t use the Service to break the law, send spam, harass people, upload malware, try to access other people’s places or accounts, overload or probe the Service, or resell it without our written OK. We may suspend accounts that do.

5. Plans, trials and billing

  • Paid plans (Home, Home Plus, Work, Work Crew and Both Yards) are billed in advance, monthly or yearly, in US dollars, through our payment processor Stripe. Prices are shown before you pay.
  • Subscriptions renew automatically at the end of each period until cancelled. You can cancel anytime in Billing at app.bothyards.com/billing (or email support@bothyards.com); cancellation takes effect at the end of the current period, and paid features stay on until then.
  • Each new place starts with a 14-day free trial that ends on the date shown in the app. After the trial, choose a plan to keep adding and changing things. Everything you saved stays readable either way; we don’t delete data because a trial or plan ended.
  • Except where the law requires otherwise, payments are non-refundable; we may issue refunds or credits at our discretion.
  • We may change prices with at least 30 days’ notice; changes apply from your next renewal.
  • Some places may receive complimentary access that we grant; we can end complimentary access with notice.

6. Availability and changes

We work to keep the Service available and your data backed up, but it is provided “as is” and may change, pause or have outages. We may add, change or remove features. We’ll give reasonable notice of material changes to these Terms; continuing to use the Service means you accept them.

7. Ending your account

You can stop using the Service at any time and ask us to delete your account at bothyards.com/delete-account. We may suspend or close accounts that break these Terms. Owners can export or request their place data before closing.

8. Disclaimers and limitation of liability

To the extent the law allows, Both Yards is not liable for indirect, incidental or consequential damages, or for lost profits or data, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

9. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Virginia, unless the law requires otherwise.
